PRITCHARD, Circuit Judge.

This case was before tbis court at November term, 1905, reported under the same title as above. 143 Fed. 193. It is again here on a writ of error based on what purports to be a bill of exceptions. Counsel for plaintiff in error moves the court to dismiss the writ of error upon the ground that the judge below who tried the case failed to sign the bill of' exceptions, and also upon the further ground that there is “nothing in the record to show that any exceptions were taken or any time given in which to present a bill of exceptions except the statement of the alleged…
