This military pay case is before the court on plaintiffs motion and defendant’s cross-motion for summary judgment. The material facts are not in dispute. On October 23, 1973, plaintiff was removed from his post as a major1 in the Regular Army of the United States, with an honorable discharge but with a prohibition against his future reenlistment, pursuant to the recommendation of a board of inquiry as modified and affirmed by a board of review *500and ultimately by the Secretary of the Army.
