*63Per Curiam : This case conies before the court on exceptions by the parties to a recommended decision filed by Trial Judge Kenneth B. Harkins pursuant to Buie 134(h). The court has considered the case on the briefs and oral argument of counsel. Since the court agrees with the trial judge’s recommended decision, as hereinafter set forth,* it hereby affirms and adopts the same as the basis for its judgment in this case. It is therefore concluded that plaintiff is entitled to recover active duty pay and allowances from July 3,1962, to the end of his then current enlistment term, March 13, 1964,…
