This case was referred to Trial Commissioner Franklin M. Stone with directions to make findings of fact and recommendation for conclusions of law. The commissioner has done so in an opinion and report filed on April 20, 1965. On June 28, 1965, defendant filed a motion for an order dismissing that part of plaintiff’s claim occurring subsequent to September 4,1955, and on August 9,1965, the court entered an order that action as to said motion be held pending consideration by the court of defendant’s brief and exceptions as to the remainder of the plaintiff’s claim. *693Exceptions were filed by the…
