— This is an appeal from the judgment of the district court of the eighth judicial district, for Kootenai county, in favor of respondent Charles Gridley and against appellant R. C. Ross for the sum of $3,145.08 and costs.

On and prior to March 1, 1919, appellant and another were the owners of a ranch in Powell county, Montana, consisting of more than a thousand acres, together with certain horses, cattle, farm machinery, hay, grain and other things comprising a farming outfit and necessary to farming operations.
