The accused, a fireman apprentice aboard the U.S.S. Sarsfield, was charged with the theft of a sum of money from a shipmate in violation of Article 121, Uniform Code of Military Justice, 50 USC § 715. Upon trial by special court-martial the accused entered a plea of not guilty but was found guilty. He was sentenced to receive a bad-conduct discharge, to forfeit fifty-five dollars per month for three months, and to be confined at hard labor for three months.
