MEMORANDUM OPINION

WALTON, District Judge.

This matter comes before the Court upon Defendant’s Motion for Summary Judgment (“Def.’s Mot.”), which was filed following the issuance of this Court’s decision in Gustave-Schmidt v. Chao, 226 F.Supp.2d 191 (D.D.C.2002), granting in part and denying in part the defendant’s motions for partial dismissal of the plaintiffs complaint. In that Memorandum Opinion, this Court dismissed the plaintiffs claims for negligent and intentional infliction of emotional distress under the Federal Tort Claims Act, 28 U.S.C. §§ 1346, 2401-680 (2000), and denied the…
