The defendant was charged in the district court of Osage county with the crime of rape in the first degree; was tried, convicted and sentenced to serve a term of 15 years in the penitentiary, and has appealed.

The only assignment of error relied upon for reversal of this case is that the evidence is insufficient to sus tain, the judgment and sentence, and that the court erred in failing to sustain a motion for a directed yerdict.
