Defendant, Bill Weston, was charged in the district court of Creek county with the crime of rape in the first degree, was tried, convicted, and sentenced to serve a term of 15 years in the State Penitentiary, and has appealed.
Before discussing the issues in this ease, we desire to quote from the case of Sowers v. Territory, 6 Okla. 436, 50 P. 257, 258. This opinion was rendered in the early Territorial days by Justice Tarsney. It discusses a question that arises in the instant case, a question that does ¡arise in many cases of this character.
