This appeal is from a judgment of conviction for rape in the first degree and sentence of imprisonment for the term of 15 years in the penitentiary. The information charges that in Harper county on or about the 6th day of April, 1919, the defendant, George Ferbrache, accomplished an act of sexual intercourse with one Frances Bailey, a female, under the age of 14 years and not the wife of the said defendant.

The assignments of error go to the sufficiency of the evidence to support the verdict, the admission and rejection of certain evidence, and the refusal to give requested instructions.
