The defendant was charged with the crime of rape in the first degree in Okmulgee county. He was tried, found guilty, and convicted by the jury, who were unable to agree upon his punishment, and by the court sentenced to> serve a term of 50 yearsi in the penitentiary. Both tbe defendant and prosecutrix are negroes. He was 84 years of age and sbe was 38 years of age, and bad been married twice.
