This appeal is from a judgment of conviction for rape in the first degree and sentence in accordance with the verdict of the jury for the term of 15 years in the penitentiary. The information charges that in Seminole county, on or about the 1st day of October, 1910, the defendant, W. A. Douglas, accomplished an act of sexual intercourse with one Jessie McKinley, a female under the age of 14 years and not the wife of the said defendant!
