Plaintiffs intestate, Laker Jonescu, met his death on January 29, 1917, by falling through a skylight on the roof of defendant’s building at 1192 Russell street, in the city of Detroit. He was a car*91penter by trade, and had been engaged by defendant to make repairs on the premises. It is the claim of the plaintiff that the deceased was employed by the defendant as a day laborer.
