delivered the opinion of the court.
The plaintiff secured a verdict and judgment against the defendant for $9,500' in an action wherein the petition alleges that the defendant negligently drove his automobile against the minor son of the plaintiff and thereby caused his death. The accident occurred about nine o’clock a. m. on April 28, 1934, on U. S. Eoute No. 24 between Peoria and Pekin. The decedent, Charles Combs, Jr., was about 15 years old at the time in question.
