The court’s prior judgment of this appeal and cross-appeal was vacated by the Supreme Court and remanded “for further consideration in light of Markman v. Westview Instruments, Inc., 517 U.S. -, 116 S.Ct. 1384, 134 L.Ed.2d 577 (1996).” U.S. Surgical Corp. v. Ethicon, Inc., — U.S. -, 116 S.Ct. 1562, 134 L.Ed.2d 662 (1996).
