MEMORANDUM OPINION

Pending before the court is an appeal filed by Chapter 7 Trastee Gary A. Rosen and Southern Management Corporation Retirement Trust (“SMCRT”) from a March 12, 2010, order of the United States Bankruptcy Court for the District of Maryland granting summary judgment in favor of Robert F. Rood, III, and Grace Ann Rood and denying their cross-motion for summary judgment.
