This is an appeal by the state of Minnesota from an order of Hennepin County Juvenile Court Judge Lindsay G. Arthur, filed June 6, 1978, vacating his order of May 30, 1978, and reinstating his order filed May 8, *3351978, in which he approved the findings and recommendation of Referee Michael E. Pridgen to deny the state’s motion to have defendant M. A. P. referred for prosecution as an adult.
