This is an appeal from a judgment releasing the petitioner from the custody of the sheriff of Hamilton county upon a petition for a writ of habeas corpus.

There was no substantial dispute as to the facts.

In December 1938, the petitioner was indicted by the grand jury of Cuyahoga county, Ohio, of the crime of embezzlement. He was arraigned, pleaded not guilty, and was released upon bond pending the trial.
