1Opinion of the Court

Berry, Judge:

This proceeding involves a petition for a writ of habeas corpus ad subjiciendum which was initially filed under the original jurisdiction of this Court on September 10,1959, and on September 21,1959, this Court entered an order refusing to grant the writ. The relator then petitioned the Supreme Court of the United States for a writ of certiorari which was granted on March 7, 1960. On April 19, 1960, the Supreme Court of the United States handed down its mandate vacating the judgment of this Court and remanding the case for proceedings not inconsistent with its opinion.
