Appeal by plaintiff from a judgment of the superior court for Pierce county, Clifford, J., entered July 10, 1907, upon the verdict of a jury rendered in favor of the plaintiff, after the withdrawal of certain issues at the instance of the defendant, in an action on contract.

In June, 1904, the respondent asked for bids for the construction of a hospital and staff cottage building, on certain lots which it owned in Tacoma, Washington, according to plans and specifications which had been theretofore prepared by its architects. The appellant submitted a bid for the work, which proved to be the lowest, and was requested to visit the architects with a view to entering into a contract.
