MEMORANDUM AND ORDER

This matter is now before the Court on defendants’ motion to dismiss plain tiff’s complaint pursuant to Federal Rule of Civil Procedure 12(b).

Plaintiff is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, and at all times material hereto was engaged in the performance of work as general contractor for the Department of the Navy.
