OPINION AND ORDER
LAGUEUX, District Judge,
Plaintiff, James D’Oliviera, commenced this action as a one-count (Count I) breach of contract case in Providence County Superior Court, after the defendant refused to grant him severance pay under an employee severance plan. Plaintiff subsequently filed an amended complaint in Superior Court in which he added a claim for violation of the Employee Retirement Income Security Act, 29 U.S.C. § 1001-1194 (1974) (“ERISA” or “the Act”), which he designated as Count III.
