The defendant, North Adams Hoosac Savings Bank (North Adams), has possession of a note which is secured by a mortgage agreement on a family house. The plaintiff, First National Bank of Cape Cod (Cape Cod), is the holder of an assignment of that mortgage agreement and note. Cape Cod commenced this action in the Superior Court pursuant to G. L. c. 231A, seeking a determination that North Adams is not a holder in due course of the note, and that Cape Cod is entitled to the monthly mortgage payments being made by the mortgagors.
