In the year 1867 Congress passed an act, approved February 5th, entitled an act to amend “An act to establish the judicial courts of the Uuited States, approved September the 24th, 1789.”* This act consisted of two sections, the first of which conferred upon the Federal courts and upon the judges of those courts additional power in regard to writs of habeas corpus, aud regulated appeals and other proceedings in that class of cases.
