OPINION
SWEET, District Judge.
The action at bar concerns the alleged failure of a purported class of producers, syndicators and distributors of television programs to obtain synchronization licenses for their use of certain musical compositions owned by the plaintiff class of music publishers and music copyright owners, all in violation of the Copyright Act, 17 U.S.C. § 101 et seq. Defendant ABC Sports, Inc.
