Judgment reversed, on the law, and indictment dismissed. Memorandum: On April 15,1977 defendant was arrested, along with two other persons, on felony charges of criminal sale of a controlled substance in the first degree and criminal possession of a controlled substance in the fifth degree. After assignment of counsel, a preliminary hearing was held on April 20,1977 at which time he was held for the Grand Jury.
