The defendant moved to dismiss this action, pursuant to CPL 170.30 (subd 1, par [e]) and 30.30 (subd 1, par [b]), contending that the People were not ready for trial within 90 days of the commencement of the action because of their failure to convert the complaint to an information within that period. The People noted, however, that, during the same period, the defendant made pretrial discovery motions.
