The defendant was convicted of having unlawful possession of intoxicating liquor in violation of the National Prohibition Act (41 Stat. 305 [Comp. St. Ann. Supp. 1923, § 10138J4 et seq.]) in the federal District Court for Rhode Island upon *23a criminal information presented by the United States attorney.
