The plaintiff in the court below, D. P. Hickey, brought suit against the appellant, Machomich Mercantile Company, a corporation, to recover on an express contract the sum of $1,208.88, which the said Hickey claimed to be due him as salary earned while in the employ of the defendant, the appellant here.
The question is brought here upon six assignments of error which will be taken up and disposed of in their order as presented by the appellant.
