This suit was originally filed against appellant by three individuals; but Mrs. Bess Grigsby is not now involved; and we herein refer to S. L. Gladish and D. F. Tajdor as “the appellees,” who are and were at all times herein mentioned the owners of the west 100 feet of lots 4 and 5, block 12, Townsite Addition to Osceola. This property was embraced in Sewer District No. 5 of Osceola, Arkansas, which district was created sometime prior to 1930 and went into receivership about 1935; and the appellant is the receiver of the said -district.
