Appellee Boyer brought this suit to foreclose a mortgage. It is alleged in the complaint that in August,, *4951878, Frances E. Williams and her husband, Lyman U. Williams, executed to Boyer a mortgage on eighty acres of land in Jasper county, to secure the payment of a note, executed by them to him; that Frances E. died in 1884, leaving surviving her husband and three sons, naming them, as her only heirs at law.
The husband and sons were made parties defendants to the suit, as was also the appellant William F. Hoes.
