— Briefly stated, the case made by the evidence is this: Israel Ulrich owned land in Wayne county; on the *35511th day of December, 1873, he executed a mortgage to the appellee Jacob Drischell to secure the payment of a note for $1,000; on the 25th day of the same month he executed another mortgage to him to secure another note for $1,500; on the 6th of April, 1874, he executed to William Sagel a mortgage for $1,300; on the-4th day of the following September he also executed a mortgage to John Graver to secure a note for $800; subsequently, Amos and Francis Kauffman recovered judgments against…
