J.'—The plaintiff, Mary Burke, the wife of the plaintiff Edward F. Burke, commenced an action against the defendant to obtain a judgment for damages caused by a breach of contract by Joseph Stanton, defendant’s testator. Her husband, Edward F. Burke, commenced a similar action. Both actions were tried together. The trial court made findings in favor of the defendant in each ease and both plaintiffs have appealed. In each case the clerk prepared a separate judgment roll and certified a separate transcript. However, both cases are supported by a single transcript by the reporter.
