This action was brought to quiet title to lots 12 and 13, block 6, of the subdivision of certain lots in the Highland Park tract in the county of Los Angeles.
It was alleged in the complaint that in October, 1885, one G. W. Morgan was the owner of the lots in controversy and on that date conveyed them to the defendant trustees of the University of Southern California, a corporation, for its benefit; that in December, 1885, the said trustees entered into an oral agreement with one C.
