Affirming.

The appellee, Gr. C. Burchett, filed suit in the Pike circuit court against appellant, Borderland Coal Company, and John Doss seeking damages in the sum of $10,000.00 for injuries alleged to have been sustained on the 10th day of July, 1916, while he was. employed by the two defendants. It was alleged in the petition that while working for the defendants, a large piece of timber was violently and abruptly thrown against the plaintiff with the result that his leg and ankle were crushed and broken and other parts of his body injured, and that the…
