Appeal from a judgment of imprisonment and from an order denying to defendant a new trial. Appellant was found guilty under an indictment charging him with having feloniously stolen and carried away $30,000, lawful money of the United States and the property of Ethel L. Hupp. The evidence in the case tells the very familiar story of the credulity of a confiding victim and the baseness of a class of men who may be catalogued in general as “bunco artists.” We may preface our statement of the evidence with the assertion, advisedly made, that the proof was abundant to show a determined and…
