This case was tried before the learned president judge of the court below, without a jury, under the provisions of the Act of April 22, 1874, P. L. 109. He reported in favor of plaintiff but did not assess the damages, because the parties had agreed this should not be done until after the question of liability was finally determined. The court in banc, in an opinion by the trial judge himself, sustained certain exceptions to his rulings, and entered judgment for defendant.
