This action was begun in the court below to recover $2,796 alleged to be due and owing to appellants by reason of respondents having rescinded a real estate contract which had existed between the parties.

The complaint alleges that, on April 8, 1929, the parties entered into a written contract whereby respondents agreed to sell and appellants agreed to buy a parcel of real estate in King county for $7,100, of which $2,194 was paid at the time, $3,600 was to be paid by the assumption of a mortgage, and the balance of $1,306 was to be paid in monthly installments; that appellants paid on the…
