-As originally commenced by the plaintiffs, Thiel and wife, this was an action seeking forfeiture of the rights of the defendants, Miller and wife, in a large ranch consisting of certain lands in Adams county in possession of the defendants under *53a contract for the purchase thereof from the plaintiffs by the defendant Miller; and also forfeiture of all sums paid by the defendants upon the purchase price of the contract.
