This action was begun in the district court for the Southern District of Indian Territory, on November 14; 190G, to recover on three promissory notes, one of which was executed by Mullen & Mullen, J. P. Mullen, J. S. Mullen, L. V. Mullen, and W. C. Rudisill,- on December 4, 1905, in the sum of $2,040, in favor of the International Bank of Coal-gate, with interest at eight per cent, per annum from maturity; the second was executed by Mullen & Mullen, J.
