This is the second appeal of this cause. The opinion on the first appeal will be found in Compton v. Jennings Lumber Co. (Tex. Civ. App.) 266 S. W. 569. In accordance with the instructions contained in the opinion by the El Paso court, the case was retried upon the issues between plaintiff in error and defendant in error alone, without reference to the other parties to the original suit.
