Error to the Court of Civil Appeals for the Fifth District, in an appeal from Delta County. Byrd sued the' railway company, and á judgment in' his favor was affirmed on appeal by defendant, who then obtained writ of error.

This suit was brought by the defendant in error against the plaintiff in error to recover damages for personal injuries alleged to have been received through the negligence of the servants of the railroad company. After the case was tried and verdict rendered, a motion for new trial was filed on behalf of the plaintiff in error, and, among other grounds for said motion, was the misconduct of the court and jury after the case had been submitted to the jury.
