This suit was brought subject to the provisions of the Federal Employers’ Liability Act (45 USCA §§ 51-39) to recover damages for the death of Ruben A. Short in a railroad wreck at a “turnout” near Eagle Ford, Tex. On the trial the jury to whom special issues in response to the pleadings of the parties were submitted found that the defendant was guilty of negligence which was the proximate cause of the death of said Short in each of the following respects, namely: (1) In failing to require T.
