EVERETT, Chief Judge:

On October 27, 1978, appellant was tried at Baumholder, Federal Republic of Germany, by a military judge, who acquitted him of a wrongful sale of heroin but convicted him of wrongful possession of heroin, in violation of Article 134 of the Uniform Code of Military Justice, 10 U.S.C. § 934. The sentence was a bad-conduct discharge, confinement at hard labor for 6 months, partial forfeitures for 4 months, and reduction to the grade of E-l.
