This action was commenced in the district court of Sequoyah county by George R. Jenkins against S. R. Helms and Mollie Helms to recover upon a promissory note in favor of Aurelius-Swanson Company and assigned to plaintiff, and to foreclose a mortgage given as security for said note, and for equitable relief. The defendants filed an answer denying that the plaintiff was a holder in due course. They admit executing the note and mortgage, but allege there was no consideration for said note, and the same was obtained by fraud .and void.
