Canary, deceased, against the Wichita Falls & Northwestern Railway Company and the Missouri, Kansas & Texas Railway Company. There was a judgment for defendants, and plaintiff brings error.

This case was commenced under the federal Employers’ Liability Act (Act April 22, 1908, c. 149, 35 Stat. 65 [U. S. Comp. St. 1913, sees. 8657-S665]), to recover for injuries alleged to have been received by plaintiff’s intestate and for the death of intestate, ensuing from such injuries. Such injuries were alleged to have occurred to plaintiff’s intestate while engaged in the employ of the defendants in interstate commerce.
