Appeal from a judgment entered pursuant to an order granting defendant’s motion for summary judgment in an action to rescind the sale of certain real estate on the ground of fraud and mistake.

Plaintiffs alleged in their complaint that defendant induced them to sell their property in Edina, Minnesota, for $18,800 by representing to them that defendant desired to purchase the property for roadway and residential purposes in accord with the then character of the neighborhood.
