DAVISON, Justice.

This is an appeal from a judgment in favor of R. C. Borum (plaintiff below) and against the City of Muskogee and Ark Valley Construction Co. (defendants below) canceling a paving assessment that was assessed against plaintiff’s property in Street Improvement District No. 239, and enjoining the defendants from extending and spreading of record such assessment against the property of plaintiff. The parties will be referred to as they appeared in the lower court or by name.
