Before the Court today is the motion brought by defendants Johnson & Johnson, Inc. (“J & J”), a New Jersey corporation, Johnson & Johnson International, a New Jersey corporation, Ortho Pharmaceutical Corp. (“Ortho”), a Delaware corporation, and R.W. Johnson Pharmaceutical Research Institute (“PRI”), an unincorporated division of Ortho (collectively, “defendants” or “Ortho”) for summary judgment against plaintiff Merckle GmbH (“Merckle”), a German corporation.
