AvePoint, Inc. and AvePoint Public Sector, Inc. (collectively “AvePoint”) filed this action against Power Tools, Inc. d/b/a Axceler (“Axceler”) and Michael X. Burns (“Burns”), asserting claims for defamation; breach of contract; trademark infringement, false association or false endorsement, false designation of source or origin, and false advertising under the Lanham Act; false advertising and unfair competition under Virginia law; and violations of the Virginia Computer Crimes Act.
